Got a dispute with a service provider? Here’s what you can do!
The first step is usually to try and resolve the issue directly with the business. However, if that is not successful, you can escalate the matter and make a complaint to NSW Fair Trading.
NSW Fair Trading helps consumers with disputes related to:
Buying goods and services
Buying a car
Warranties and repairs
Home building and renovations
Renting, buying, or selling a home
Strata, retirement villages, and residential land lease communities
Be sure to check the appropriate time limit for filing your dispute with Fair Trading. For example, the Home Building Act provides statutory warranties for a period of six years for major defects and two years for all other defects from the date of the completion of home building work.
While NSW Fair Trading helps mediate disputes, it doesn’t provide detailed legal advice tailored to you. Whether you’re lodging your complaint, or your dispute has escalated to the NSW Civil and Administrative Tribunal (NCAT), having an experienced lawyer by your side is invaluable.
Joselyn from Montgomery Legal Practice offers expert guidance on your rights under the Australian Consumer Law, particularly in complex cases involving large sums of money, complex contracts, or breaches of warranties – helping increase your chances of a more favourable outcome.
